Man accused of attempted murder makes court appearance

RAPID CITY, SD (KEVN) - Cruz Deleon made an appearance Monday in in Seventh Circuit Court in front of Judge Jeff Davis for a status hearing.

Deleon is charged with attempted first degree murder, aggravated assault on law enforcement, commission of felony with a firearm, possession of a controlled substance and false personation. The charges stem from an incident last summer, when Deleon was accused of threatening an officer with a firearm. According to the police report, Deleon pointed a gun at Officer Jakob Whittle and also had possession of methamphetamine.

Deleon's attorney Paul Winter earlier filed a motion for a mental health evaluation to prove that his client' does not have the mental capacity to comprehend the nature and purpose of the proceedings against him.
Today Judge Davis set Deleon's next court appearance for June 18th when the evaluation should be completed.
