Graham conviction upheld

The South Dakota Supreme Court has upheld John Graham's murder conviction and life sentence in the 1975 slaying of Anna Mae Aquash on the Pine Ridge Reservation.  Graham was convicted in 2010 of taking part in the killing of Aquash.

Prosecutors say Graham and two other American Indian Movement activists killed Aquash because they thought she was a government informant.  Graham is a member of a tribe in Canada and argued that the government should not have been allowed to move his case from federal court to state court after he was extradited to the U-S.   The Supreme Court unanimously ruled that the state had jurisdiction to prosecute Graham and that prosecutors had enough evidence to convict him.
