Birdshead back in court

The man accused of fatally shooting Eustacio Marrufo in the South Dakota Rose Inn parking lot in January was back in a Rapid City courtroom Monday asking for specific evidence.   30-year old Charles Birdshead is facing a total of eight charges that include three alternative counts of first degree manslaughter,  commission of a felony with a firearm, possession of a controlled weapon, distribution of a controlled substance to a minor and two counts of fourth degree rape.  Birdshead's attorney asked for two specific items in the state's possession that she wants examined in regard to the rape charges.  Those items include the purse and underwear of the alleged 15-year old victim.  The defense was granted the evidence to be tested individually for blood and DNA analysis.The defense was also granted names, addresses, and phone numbers of witnesses that had been redacted out of police reports.  The state says they believe those witnesses may be threatened if their contact information is released.Birdshead is due back in court on April 16th.
