Defense questions DSS over Berges interview

A Rapid City man facing a second degree murder charge was back in court Friday afternoon. Edward Berges is accused of killing his girlfriend's young daughter. The issue in Friday's hearing was over an interview done with Berges at the Pennington County Jail without his attorney present.

Two employees of the Department of Social Services said in court that a DSS worker did interview Berges at the jail without trying to contact attorney Dana Hanna. Hanna said that violates his client's constitutional rights. DSS said the interview was standard protocol in doing an initial family assessment involving another child in the family.
