Prison guard killer court proceedings enter third day

The 49-year old man who admitted to killing a South Dakota prison guard last year was back in a Sioux Falls courtroom Wednesday. It is the third day of the pre-sentence hearing for Rodney Berget, one of the men who killed guard Ronald Johnson during a failed prison escape.

The hearing allows a judge to hear testimony that will be used in deciding if Berget will get life in prison or the death penalty. Another inmate, Eric Robert, has already been sentenced to death for his role in the murder. In court, a paralegal from the Minnehaha County Public Defender's Office testified that the execution of Berget's brother was a sad point in his life. Berget's brother admitted to killing an Oklahoma man.
