Judge weighs sentencing decision
Tuesday, 31 January 2012 12:41
The pre-sentencing hearing for a South Dakota inmate accused of murdering a state prison guard continued today in Sioux Falls.  A judge is weighing whether 49-year old Rodney Berget should spend life in prison or get the death penalty for his role in attacking and killing 63-year old Ronald Johnson all in an effort to escape prison.

The widow of Johnson says her husband's death was a needless act.  A correctional officer also testified today about Berget's other failed escape attempts.  The state says the inmate tried seven times to get out of prison.  Judge Bradley Zell earlier sentenced Eric Robert to death for his part in the crime after Robert pleaded guilty.  A third inmate has been charged with providing the materials used to kill Johnson.
