A Rapid City magistrate judge facing a second–offense drunken driving charge will not preside over DUI cases while his own proceeds. Pennington County State's Attorney Glenn Brenner says attorneys and court officials decided to have other judges handle those cases to avoid "perceived conflicts or uncomfortableness.'' 56–year–old 7th Circuit Magistrate Judge Mark Marshall was arrested Oct. 23 after authorities say he was driving the wrong way on Interstate 229 in Sioux Falls. He is due in court Nov. 12. Marshall did not immediately return a telephone call from The Associated Press seeking comment Friday. Associated Press |
