RAPID CITY, S.D. (AP) _ A lawsuit alleging an illegal search of
a woman during the Sturgis Motorcycle Rally four years ago will go
forward.
A federal judge on Wednesday denied summary judgment in favor of
the city of Sturgis, its police chief and two people working as
deputized police officers at the 2006 rally. They argued they have
immunity from civil lawsuits.
A Colorado woman is suing them for civil rights violations. She
says there was no basis for an outer body search and a body cavity
search of her after police stopped a vehicle for an open container
violation and found cocaine on one occupant. She was not arrested
or charged with a crime.
