SIOUX FALLS, S.D. (AP) _ The American Civil Liberties Union is
asking the U.S. Supreme Court to review a case regarding the makeup
of City Council districts in the South Dakota town of Martin.
A federal appeals court last May affirmed a judge's decision
five years ago to dismiss a lawsuit alleging that the makeup of the
districts violated the voting rights of American Indians.
The ruling vacated previous rulings favoring the ACLU in a
lawsuit filed in 2002 on behalf of two Indian voters.
Martin is in Bennett County adjacent to the Rosebud and Pine
Ridge reservations in southern South Dakota. The ACLU says Indians
make up nearly half of Martin's population but a redistricting plan
adopted in 2002 ensures that white voters control all three City
Council districts.
